These Terms of Service ("Terms") govern your use of the Radar PlantScan mobile application ("App") provided by Tomita Tech ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

App Description and Services

Radar PlantScan is a mobile application that provides:

• AI-powered plant identification through photo analysis
• Plant health diagnosis and treatment recommendations
• Personal plant collection management
• Care reminders and scheduling tools
• Plant care guides and information

Our services are designed for educational and informational purposes to help you care for your plants.

Eligibility and Account Requirements

To use Radar PlantScan:

• You must be at least 13 years old (or the minimum age in your jurisdiction)
• You must have the legal capacity to enter into these Terms
• No account registration is required for basic app functionality
• Subscription purchases require a valid App Store or Google Play account

Parents or guardians are responsible for supervising minors' use of the App and any purchases made.

Premium Features

Our premium subscription includes:

• Unlimited plant identifications
• Unlimited health diagnosis
• Unlimited care reminders
• Family sharing (up to 6 members)
• No hidden caps or limits

Subscription Plans

• Monthly: $4.99 per month
• Annual: $49.99 per year
• Free Trial: 7 days (cancel anytime during trial period)

Billing and Cancellation

• Subscriptions are managed through your App Store or Google Play account
• You will not be charged if you cancel during the free trial period
• Subscriptions automatically renew unless canceled before the renewal date
• You retain access to premium features until the end of your billing period
• Refunds are subject to App Store and Google Play policies

Acceptable Use

When using Radar PlantScan, you agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Not use the App to identify plants for commercial purposes without permission
• Not share your subscription access beyond the allowed family sharing limits
• Not attempt to circumvent any security measures

AI Accuracy and Limitations

While our AI technology is highly accurate, you acknowledge that:

• Plant identification may not always be 100% accurate
• Health diagnosis should not replace professional botanical advice
• Treatment recommendations are general guidelines, not specific prescriptions
• You should verify important plant information from multiple sources
• We are not responsible for plant care decisions based on App recommendations

Intellectual Property

Radar PlantScan and all related content are owned by Tomita Tech:

• The App, its design, and functionality are protected by copyright and trademark laws
• Plant information and care guides are compiled from various sources and our expertise
• You may not copy, distribute, or create derivative works from our content
• Your plant photos and data remain your property and stay on your device

Disclaimers and Limitation of Liability

Disclaimer: The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free or continuously available.

Limitation of Liability: To the maximum extent permitted by law, Tomita Tech shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

Privacy and Data Protection

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy highlights: We don't collect personal data, your plant information stays on your device, and plant identification images are processed anonymously and immediately deleted.

Updates and Modifications

We may update these Terms from time to time:

• Changes will be posted in the App and on our website
• Continued use of the App after changes constitutes acceptance
• We may update the App to improve functionality and add features
• Some updates may require acceptance of new Terms

Termination

These Terms remain in effect until terminated:

• You may stop using the App at any time
• We may terminate your access for violation of these Terms
• Subscription terms survive termination until the end of the billing period
• Your local data remains on your device after termination

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Tomita Tech is located. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.

For subscription-related disputes, you may also have rights under your local consumer protection laws and App Store/Google Play policies.
